If My Car Was Hit While Parked – Have you ever bumped into the bumpers of a parked car in a parking lot and failed to leave a note? Have you ever returned to your car and discovered a scratch or dent that happened while you were in the shop? These are considered hit-and-run accidents … or failure to remain at the scene of an accident.
Hitting a parked car on the street without leaving a note or immediately contacting the owner results in the same hit and run ticket as minor parking incidents. It seems much more serious, but the same part of the law applies. Most often this happens in the early hours of the night, and the police always suspect that the offending driver was probably in a state of health at the time. Even cutting the mirror and not leaving a note is an accident.

If my car hits an empty car in the parking lot, but there is no damage, should I leave my details? I’m worried that if I leave a note, they will claim that I caused damage that has already been done. – Mark, Toronto
“If you hit something or someone with your car, that’s a collision, period,” says Traffic Const. Clint Stiebe. “It’s best to leave your details — if you don’t, you could be charged.”
In Ontario, you must report an accident to the police or a collision reporting center if the damage is more than $1,000 or if someone is injured, under section 199 of the Highway Traffic Act (HTA). In the Northwest Territories, Alberta, Nova Scotia and Newfoundland, the limit is $2,000.

“In most cases, even a small amount of damage to vehicles is over $1,000, and as a result, in most cases, the offender will be charged,” says Const. Tough.
It’s a good idea to report it, even if you think the damage is minor — because you could be wrong, he adds.
“You have to report it to protect yourself, but there’s no requirement in the Road Traffic Act,” he says. “There are some insurance companies that waive your deductible if you report it to the police within 24 hours.”
If you report it to the police, do you still have to leave a note for the other driver? A little cloudiness.
What To Do After A Hit And Run On Your Parked Car In California
This part of MTV doesn’t say you have to give your insurance contact details to anyone other than the police. However, if you pull into a parking space, the police can also charge you with failing to stop at the scene of an accident under the Criminal Code of Canada.
Ontario’s HTA has a similar rule, but it only applies on the road, not in private parking lots.
If you’re in a collision with another car and you’re more than 25 percent at fault, your insurance company is allowed to raise your rates — even if there’s no damage, according to the Insurance Bureau of Canada.
“A crash shows that you weren’t paying attention and that you’re not as good a driver as someone who didn’t crash,” says Pete Karageorgos, IBC’s director of consumer and industry relations.
Is It Okay To Leave A Note If You Hit A Parked Car?
Auto repair shops can identify existing damage and exclude it from the claim, says Karageorgos. But the dollar value of the damage usually doesn’t affect how much your rates will increase.
“Some companies will forgive damages below a certain threshold — that’s a good question to ask them when you’re shopping for a policy,” says Karageorgos.
It’s a good idea to take detailed pictures of both vehicles – and get information from anyone who saw the accident.
“Photos help, witnesses help, video recorders help,” he says. “We are seeing cases of insurance fraud where people are trying to make claims even though both vehicles have minimal damage.”
Does Car Insurance Cover Your Parked Car?
If someone tries to get insurance to pay for existing damage to their car, they can be charged with insurance fraud. And they could see their own insurance rates go up too – even if you were the one who hit them.
“In the case of conflicting stories, there is a possibility of a 50/50 split of fault and this will be subject to a loss on both drivers’ insurance cards,” says Ken Dusenberry, relationship director at CAA Insurance.
If you don’t tell your insurance company about the accident because you choose to deal with it privately, they may not protect you if the person you hit files an injury claim.
“I know a lot of people don’t want to report these things to insurance companies, but they’re also there to protect you,” says Stiebe of the Toronto Police. “If there’s a civil suit and they claim they have whiplash, you could be left holding the bag if you didn’t report it.” We value your privacy.
